1. Acceptance of Terms

Welcome to CourtLink. By accessing or using our court booking platform and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

2. Description of Service

CourtLink is an online platform that connects players with tennis courts and other sports facilities. The Service allows users to:

• Search for and discover courts and sports venues
• View court availability and amenities
• Book court time at participating venues
• Manage bookings and view booking history

For venue operators, CourtLink provides management tools ("CourtLink OS") to manage court schedules, bookings, and operations.

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Types

CourtLink offers different account types for players and venue operators. Each account type has different features and permissions. You agree to use your account only for its intended purpose.

4. Bookings and Payments

4.1 Booking Process

When you make a booking through the Service, you enter into a direct agreement with the venue operator. CourtLink facilitates the booking but is not a party to the agreement between you and the venue.

4.2 Pricing

Court rental prices are set by individual venue operators. Prices displayed on the Service are as provided by venues and may be subject to change. All applicable taxes and fees will be displayed before you confirm your booking.

4.3 Payment Processing

Payments are processed through our third-party payment processors. By making a payment, you agree to the payment processor's terms of service. CourtLink does not store your complete payment card information.

4.4 Cancellations and Refunds

Cancellation and refund policies are set by individual venue operators. Please review the venue's cancellation policy before making a booking. CourtLink will facilitate refunds in accordance with venue policies but is not responsible for refund decisions made by venues.

5. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Provide false or misleading information
• Make bookings you do not intend to honor
• Attempt to circumvent any security features of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Scrape, crawl, or use automated means to access the Service without permission
• Impersonate any person or entity
• Harass, abuse, or harm other users or venue staff
• Use the Service to transmit spam, malware, or other harmful content

6. Venue Operators

If you are a venue operator using CourtLink OS, you additionally agree to:

• Provide accurate information about your venue, courts, and availability
• Honor all bookings made through the Service
• Maintain a safe environment for players
• Comply with all applicable laws and regulations
• Respond to booking inquiries and issues in a timely manner
• Keep your pricing and availability information current

7. Intellectual Property

The Service, including its content, features, and functionality, is owned by CourtLink and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

"CourtLink," the CourtLink logo, and "CourtLink OS" are trademarks of CourtLink. You may not use these marks without our prior written permission.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, COURTLINK DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy, completeness, or usefulness of any information on the Service.

CourtLink is not responsible for the actions, content, or policies of venue operators. Your interactions with venues, including bookings and payments, are solely between you and the venue.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURTLINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO COURTLINK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless CourtLink and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time by contacting us. Upon account deletion, we will delete or anonymize your personal information in accordance with our Privacy Policy, except where we are required to retain it by law.

12. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.

You agree to first attempt to resolve any dispute informally by contacting us. If the dispute is not resolved within thirty (30) days, either party may pursue formal legal action in the state or federal courts located in Massachusetts.

13. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and CourtLink regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
